What are the chances of that happening? Can you get a drunk in public charge by walking home from the bar?
Yes...if you are noticeably intoxicated. This would included but not limited to vomiting, falling, staggering, crawling, wondering aimlessly, and/or visibly not making any sense. Hope this helps.
Oh crap, yes.
And take it from me, it doesn't help to say "You can't arrest me! I pay taxes! I'm YOUR boss!"
Boy will you regret it.
If you can walk straight and not puke on yourself hopefully you can fool them all. Remember to NEVER NEVER take a "sobriety test." First of all, you're not driving, so they can't make you take a blood or blow test. But if they ask you to count backwards by threes (who in christs name can do that, anyway?!?) or walk a straight line POLITELY DECLINE. Here's the thing: this cop already believes you are loaded. And there's no objectivity to the test. If the cop already thinks you're drunk, it's not like you can get an actual score that will somehow PROVE you're not drunk. If you do well in the test it just proves what a drunk you are that you have such high tolerance. If you trip all over the place and drool it proves you drank way too much. It is a lose lose and can never help you. You could play "Flight of the Bumblebee" perfectly on a miniature iPhone keyboard app and the cop can still say you acted and smelled drunk.
The best way to get out of a bar when you're 3 sheets to the sailboat is to disguise yourself as some sort of bush or ficus. Like Scooby Doo might do. Then "twinkle tip toe" ten feet at a time, resume your bush posh, and scope out the scene. Repeat til you are home.
Be careful! Can you get a drunk in public charge by walking home from the bar?
Absolutely. It would depend on the officer/their mood/your demeanor/what area your in/endangering yourself or someone else/other surrounding factors/etc.
Theoretically yes but I would imagine that if you are not disturbing the peace you would not receive any ticket. Can you get a drunk in public charge by walking home from the bar?
Can you? Yes. Will you? Usually only if you give the police a reason to.
Yes if the cop wants to be a hard *** or you have an attitude.
