maybe not criminally, but civilly you bet. if a person dies as a result of a drunken patron, the bar can be sued for wrongful death.
Sort of. I think that you are partially responsible for calling someone a cab if you have served them too much. This is why bartenders often choose to just cut someone off. However, it is not your job to make sure they get into the cab. it's not that you are technically responsible for them to get home safely but as long as they are in your bar you are responsible to make sure they A) don't drink over a limit B) if noticeable way over the limit try to call a taxi for them or have them call a buddy to pick them up or C) try to hold them in the bar so you can sober them up a little. You have to always watch to see how much your patron has had and if they are staggering or slurring of words that would be your best time to cut them off.
In most states it's illegal for a bartender or waitress to serve to excess.
So, if they do it anyway, then they should certainly be morally, if not legally, responsible for seeing that the drunk customer gets home safely and ensuring the safety of others on the road.
